Terms & Conditions

These Terms and Conditions form a legally binding agreement between you and Martin Campbell Design & Build ABN 78 955 403 918. By visiting our website, requesting a quotation or commissioning any renovation or building work in Queensland you confirm that you have read, understood and agree to these Terms. If you do not accept them, you must not engage our services.

Definitions

“Client”, “you” or “your” means the individual or entity requesting our Services.

“Contract” means the written quotation, drawings, schedules and these Terms once accepted.

“Services” means all design, bathroom renovation, home-extension, house-renovation and related work we agree to perform.

“Variation” means any change to the Scope of Work after the Contract is formed.

“Scope of Work” means the specific tasks, materials, allowances, exclusions and estimated timetable shown in the quotation.

Formation of Contract

A quotation is an invitation to treat, not an offer capable of immediate acceptance. A Contract arises only when (a) you accept the quotation in writing within its validity period and (b) the stated deposit is paid. If acceptance is received after the validity period we may confirm the original quotation or issue a revised one.

Scope of Work and Service Descriptions

Bathroom Renovations: A standard bathroom renovation normally involves demolition of existing fixtures, plumbing preparation, waterproofing, tiling, lighting, installation of new sanitaryware and carpentry finishes. Where walls are removed or structural changes introduced, additional plastering or engineering work may be required. A basic bathroom renovation generally takes ten to fourteen working days, provided all required materials are on site and free of defects.

Home Extensions: Each extension project begins with a site visit, design advice, preparation of drawings, any required planning or council approvals, and a detailed quotation. Works are then scheduled in stages, with a deposit payable before commencement and further payments due at completion of each stage.

Full-House Renovations: Whole-of-home renovations follow a similar process of site visit, planning, quotation, staged payments and progress-based invoicing.

Any item or activity not expressly included in the quotation is excluded.

Client-Supplied Materials

  • Unless otherwise agreed in writing, you are responsible for supplying tiles, sanitaryware, tapware and other selected finishes. We recommend sourcing from reputable local suppliers to avoid delays caused by shipping damage, mismatched batches or stock shortages; online purchases are discouraged for the same reasons.

  • You must ensure that client-supplied items (a) meet Australian standards, (b) are delivered to site on or before the date nominated in the construction programme and (c) are free from obvious damage.

  • MCDB is not liable for project delays, extra labour or rescheduling costs caused by late, defective or incorrect client-supplied materials. Any such costs will be treated as a Variation.

Pricing and Payments

  • All prices are in Australian dollars and include GST unless stated otherwise.

  • Deposits, progress payments and final balances are payable on the dates or milestones shown in the quotation. Invoices fall due seven calendar days from issue.

  • If payment is late, interest may be charged at the Reserve Bank of Australia cash rate plus five per-cent per annum until cleared funds are received.

  • Materials purchased specifically for your project become your property upon full payment of the relevant invoice.

Variations

If you request, or we reasonably deem necessary, any change to the Scope of Work we will issue a Variation describing cost and time effects. No Variation proceeds without your written approval. Variation sums are payable with the next progress claim.

Client Obligations

You must provide safe, unhindered access to the site during agreed working hours, maintain essential services (electricity, water, sanitation), obtain owner-controlled consents or permits, and disclose in writing any hazardous materials such as asbestos.

Timeframes and Delays

Any timeframe we state is an estimate. We are not liable for delays caused by weather, pandemic restrictions, industrial disputes, supplier shortages, council processing times, client-supplied material issues or other factors beyond our reasonable control. We will notify you promptly of any delay and use reasonable endeavours to reduce its impact.

Statutory Warranties and Guarantees

Workmanship is protected by the statutory warranties set out in the Queensland Building and Construction Commission Act 1991 (currently six years six months for structural defects and twelve months for non-structural defects). Manufacturer warranties apply to fixtures and fittings. To the extent permitted by law, all other warranties are excluded. Your non-excludable rights under the Australian Consumer Law are unaffected.

Limitation of Liability

To the maximum extent permitted by law our liability for loss or damage arising from the Contract is limited, at our option, to re-supplying the Services or paying the cost of having the Services re-supplied. We are not liable for indirect or consequential loss, loss of profit or loss of enjoyment.

Intellectual Property

Concepts, drawings, specifications and other documents we create remain our intellectual property until all monies owed have been paid. After full payment you receive a non-exclusive licence to use those documents solely for the project described in the Contract.

Marketing Consent

Unless you withdraw consent in writing, you grant us permission to photograph or film the project before, during and after completion and to use those images for our portfolio, website, social media and other marketing material.

Privacy

Personal information is collected, used and stored in accordance with our Privacy Policy, available from our website.

Termination

Either party may terminate the Contract if the other commits a material breach that remains unremedied fourteen days after written notice. Upon termination you must pay for (a) all work performed, (b) materials ordered and (c) reasonable costs incurred up to the termination date.

Dispute Resolution

If a dispute arises the parties must first attempt to resolve it through direct negotiation. If unresolved after ten business days, either party may refer the matter to the Queensland Building and Construction Commission (QBCC) or the Queensland Civil and Administrative Tribunal (QCAT) before commencing court proceedings.

Governing Law

These Terms are governed by the laws of Queensland. Each party submits to the non-exclusive jurisdiction of the courts of that State.

Amendments

MCDB may amend these Terms from time to time. The version in force on the date of your quotation forms part of your Contract. Updated Terms apply only to future quotations and contracts.
